All services are customized according to client requirements and are subject to the applicable proposal, quotation, service order, agreement, or contract accepted by the client.

Payment Terms

All applicable service charges, fees, packages, credits, subscriptions, and other commercial terms will be communicated to the client before commencement of the relevant service.

• All payments must be made in advance unless otherwise agreed in writing.
• Services will commence only after receipt and confirmation of the applicable payment.
• Pricing may be revised from time to time based on service requirements, third-party charges, infrastructure costs, regulatory requirements, or business considerations.
• Failure to make payments within the agreed period may result in suspension, restriction, or termination of services.
• Any additional work, features, integrations, campaigns, or services outside the agreed scope may be charged separately.

For SMS, RCS, WhatsApp API, voice messaging, and similar communication services, applicable charges may depend on message volume, communication type, platform requirements, operator or provider charges, and other applicable service conditions.

No Refund Policy (Strict Policy)

All payments made to Suraj Enterprise are final and non-refundable, subject to applicable law and the specific terms of any written agreement.

Due to the digital and customized nature of our services, including website development, hosting setup, digital marketing campaigns, API integrations, RCS messaging, SMS services, communication credits, and related technology services:

• No refunds will be provided once a service has been purchased or initiated.
• No refunds will be issued for partially used services.
• No refunds will be issued due to change of mind or change in business requirements.
• No refunds will be issued for unused SMS credits.
• No refunds will be issued for unused RCS or messaging credits.
• No refunds will be issued for unused API credits.
• No refunds will be issued for unused hosting duration.
• No refunds will be issued for marketing retainers or partially used campaigns.

All services provided by Suraj Enterprise are digital and customized in nature. Once purchased, services are non-refundable and non-returnable. Clients are advised to carefully review the service description, pricing, scope, and applicable terms before making payment.

RCS & SMS Services

Suraj Enterprise provides RCS and SMS communication solutions for businesses, including transactional, informational, authentication, promotional, customer-support, and other legitimate business communications.

Clients using RCS or SMS services are responsible for ensuring that their messaging activities comply with applicable laws, regulations, telecom requirements, messaging platform policies, and industry standards.

• Clients must provide accurate recipient information.
• Clients are responsible for obtaining appropriate recipient consent wherever required.
• Messages must be sent only for lawful and legitimate business purposes.
• Clients must ensure that message content is accurate and not misleading, fraudulent, abusive, or unlawful.
• Clients must comply with applicable RCS, SMS, telecom operator, and messaging platform requirements.
• Appropriate opt-out or preference-management mechanisms must be provided for promotional communications where applicable.
• RCS and SMS services must not be used for spam, fraud, harassment, unauthorized messaging, or unlawful activities.

Suraj Enterprise reserves the right to restrict, suspend, or terminate messaging services where activity appears to violate applicable laws, regulations, telecom requirements, platform policies, or these Terms & Conditions.

RCS & SMS Message Delivery

Delivery of RCS and SMS messages may depend on telecommunications operators, messaging platforms, network availability, recipient devices, third-party infrastructure, routing systems, and other factors outside the direct control of Suraj Enterprise.

While we make reasonable efforts to provide reliable communication services, Suraj Enterprise does not guarantee uninterrupted service or successful delivery of every RCS or SMS message.

Service Delivery

• Project timelines depend on the nature and scope of the service.
• Project timelines also depend on timely client cooperation and submission of required materials.
• Clients are responsible for providing required content, credentials, approvals, documents, brand assets, technical information, and other materials within the agreed timeframe.
• Delays resulting from incomplete information, delayed approvals, changes in requirements, or other client-related circumstances will not be considered the responsibility of Suraj Enterprise.
• We strive to maintain reliable availability for hosting services but do not guarantee uninterrupted service due to maintenance, technical issues, network failures, infrastructure issues, third-party dependencies, or external factors.
• RCS, SMS, WhatsApp API, voice messaging, and other communication services may depend on third-party platforms, telecom operators, messaging networks, and regulatory requirements.

Client Responsibilities

Clients are responsible for ensuring that all information, content, data, promotional material, recipient information, and instructions supplied to Suraj Enterprise are accurate, lawful, and authorized for use.

• Clients must not use our services for unlawful activities.
• Clients must not violate intellectual property rights or privacy rights through the use of our services.
• Clients must obtain all required consent, authorization, license, or permission for customer data and communications.
• Clients must comply with applicable telecom, messaging, advertising, privacy, and data-protection requirements.

Intellectual Property

Unless otherwise agreed in writing, intellectual property owned or licensed by Suraj Enterprise, including software, website components, designs, systems, templates, technology, trademarks, documentation, and proprietary materials, remains the property of Suraj Enterprise or its respective licensors.

Third-Party Services

Certain services may depend on third-party providers, including hosting providers, telecom operators, RCS platforms, SMS gateways, WhatsApp providers, payment gateways, advertising platforms, APIs, and other technology providers.

Suraj Enterprise is not responsible for service interruptions, policy changes, delivery failures, pricing changes, restrictions, or other circumstances arising directly from third-party providers.

Suspension or Termination

Suraj Enterprise reserves the right to suspend, restrict, or terminate services where:

• Required payments are not received.
• The service is being misused.
• The client violates these Terms & Conditions.
• The client's activity creates legal, regulatory, security, or reputational risk.
• Messaging activity violates applicable RCS, SMS, telecom, or platform requirements.
• Suspension or termination is required by a third-party provider or competent authority.

Additional Terms

Clients agree to use Suraj Enterprise services responsibly and in accordance with all applicable laws, regulations, industry standards, and third-party platform policies.

Any service-specific conditions, commercial terms, technical requirements, usage limits, messaging policies, or additional obligations communicated in an applicable proposal, quotation, agreement, or service documentation will also apply to the relevant service.

Disclaimer

Suraj Enterprise makes reasonable efforts to provide reliable and professional services. However, we do not guarantee that all services will always be uninterrupted, error-free, or available at all times.

Digital marketing performance, advertising results, SEO rankings, website traffic, messaging delivery rates, and other performance-related outcomes may vary based on market conditions, algorithms, third-party platforms, customer behavior, network conditions, and other factors beyond our reasonable control.

Limitation of Liability

To the maximum extent permitted by applicable law, Suraj Enterprise shall not be liable for indirect, incidental, consequential, or unforeseeable losses arising from the use, suspension, interruption, or inability to use our services. This includes losses resulting from third-party platform outages, telecom network issues, messaging delivery limitations, hosting interruptions, platform policy changes, or other circumstances beyond our reasonable control.

Changes to These Terms

Suraj Enterprise reserves the right to modify or update these Terms & Conditions from time to time to reflect changes in our services, technology, business practices, regulatory requirements, or applicable laws. Updated terms will be published on this page with the revised effective date.
